PCN Bath Lane Glasgow, 2nd Stage appeal

Hi all, avid observer, 1st time poster so hope I have set out as per rules/guidelines. Wish I had seen this site prior to appealing with the issuing authority, Glasgow City Council.

A PCN was issued for in Bath Lane Glasgow. A Penalty Charge Notice attached to the vehicle.


Glasgow City Council state that the road where the car was issued was subject to a loading restriction from 8-6pm Mon-Sat Goods vehicles only. I can confirm that the ticket was issued on a week day during those "restricted" hours.

A 1st stage appeal was sent stating that it was the belief there was no case to answer as yellow lines where car was parked were non existent (faint yellow splodge on road ) and faint line to the front of the car. double yellow kerb markers were not present and signage was approx 100 ft from car. This is contrary to that of the distance stated in the letter. The vehicle was positioned predominantly on the road and and partly on dropped narrow kerb.

Any advice assistance would be gratefully received as not sure if there is a case here or not. I have been away on leave so only just got this the other day and therefore have just over a week to formally reply.

    Have a read through some of the other threads there before you post your own to get the hang of what information they need from you in your opening post - but as a minimum you will need photos/scans of all correspondence you've received from the council (both sides, if appropriate).

    PePiPoo has an excellent success record in dealing with council tickets.

    If you got no replies on pepipoo you need to bump your own thread because they will NEVER see it if it's not on page one at first - you must have posted at a busy time and it dropped off the first page too soon. I would add a reply with a picture of both sides (yes both sides) of the original PCN which sems to be the important thing missing from your post there.

    You certainly have a case, IMHO - those lines are non existent, that's not just a little bit of fading or a break in an otherwise clear yellow line!

    Also I was interested to see that they are having to correct a mistake in the formal appeal form about the time you have to appeal = I would say that in itself is a procedural impropriety (which is an appeal point in itself).

  • Hi Coupon-mad, thanks for your reply. Yes was thinking that as that way it will appear on page 1 again.
    I cant find the original PCN, not sure what I have done with it.


    Yes its an interesting one. The line seem to disappear about 3 foot from the front of the car which I assumed the restriction had ended therefore ok to park.


    Yes turn around on appeal time which as you say should be an appeal itself.

  • Do you have photographs ?
    You have to be very technical and cite the actual rules.
    The contravention did not occur because : The road markings are not compliant with regulations xxxxx.
    They will reject in anyway but the adjudicator does not like you raising issues you did nor give the council chance to address.
    You must also obtain certificate of postage for everything you send and if they do not reply in timescale automatically apply for the next stage citing none reply to appeal as well.
    I do Contracts, all day every day.

    Technical and cites I'm not terribly familiar with, is this something that I can find out relatively easily or...?

    Yes, have kept certificates of posting for all correspondence thanks (Dont want to give them an excuse for not replying if they lose them)! ;)
