Hi all,
I am hoping that someone may be able to help me. I have today (19th nov) received a PCN from Smart Parking for me overstaying my welcome at Asda in Abbey Rd Cov. There are 2 photos of me entering and leaving the car park on 31st October. The letter itself is dated 17th nov so I'm wondering if I can appeal on the grounds of this?

If you read the "Newbie" threads, they will tell you all you need to know? The time you entered and left is irrelevant as far as I am aware,.
Your appeal will be based on other factors.
Once you read the "Newbie threads" all will be a lot clearer as long as you take your time to digest the information provided.
When you are ready with your appeal(draft) letter. You will understand this once you have done some reading/research , post it on here for the experts to check over.
They will cross the eyes and dot the T's for you.
Also never admit to being the driver?? You are only the registered keeper0 -
Why wonder - just send the Newbies template first appeal - Smart will cancel by New Year.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You can send an appeal based on OUT OF TIME, but do read the Newbies thread. Basically, keeper liability can NOT be invoked if the PPC misses the strict cut off of 14 days for an ANPR case.
Now, unless there are any things you have missed off - such as it being a hire car and the PPC got your name from the hire company - then your simple appeal is on the basis that you are the registered keeper and not the driver on the day (or you refuse to name the driver). They have missed the 14 day deadline and therefore can not come after you.
You can add the other main appeal points, but the main killer is the one you picked up about out of time.0
