New oven broke

HI
We purchased a fan assisted oven from Argos, made and delivered by Indesit, It was June we fitted it straight in the spot of the old one.
On Sunday OH turned it on and it di not come on, so he turned it off and tried it again and it came on.
Last night I cooked a couple of chicken breasts, and about 10.30 turned it on again and it would not come on, tried several times but it would not work at all.
Came on this morning though when I tried it, have called Indesit today and they are sending someone out Monday to look at it.
My question is am I entitled to a new oven or just a repair, to be honest I don't want it repaired, it hasn't been used much at all, we used the BBQ all summer.
thanks
sam

Your rights are legally with the merchant not the manufacturer.
Given how long you have had it then legally you will be deemed to have accepted it and so its the merchants decision if they resolve the issue by repair, replacement or refund. You can express a preference but cannot force one or another solution.
Outside of your statutory rights there may well be warranties and guestures of goodwill to be had but these all depend on the terms/ people you speak to etc.0 -
The supplier (Argos) can repair, refund or replace (their choice).0

Hi
thanks for the replies, when I went on Argos website today to see who to call it says all the names of companies and which number to call so I didn't actually deal with Argos, does that make sense.
So should I have called Argos and not one of the numbers they have on the website?
thanks

Usualy Argos just organise to have the goods sent back to the manufacturer or for the manufacturer to come out anyway so all you've really done is cut out the middle man.
We do recommend contacting the retailer first (especially if its less than 6 months from purchase) but sometimes going via the manufacturer can be easier/quicker/better.
I'd wait and see what their engineer says - it may be something small thats broken/faulty and be a tiny part that needs replaced or perhaps its unrepairable and they'll offer a replacement anyway. You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -

Your statutory rights are with the retailer but if the manufacturer is willing to deal with it then generally there are no issues and often things are quicker, you just can demand even less of them than you can the retailer.
As from neither can you demand what you want you may as well progress with the manufacturer and in particular for an item that requires fitting so not easy to take back to the shop0
