Do I need to nag my solicitor????

    It's worth calling your solicitor to ask them if they are still waiting for any other information from the vendor and if they have started the searches yet. If they are waiting on information from the vendor then call the EA and let them know so they can chase the vendors solicitor. However as you are buying from your current landlord I'm assuming you probably already have their contact details so if there is a delay on their side maybe call them and ask why the delay is happening.

  • I nag EVERY EVERY DAY my solicitors, I constantly ask them for an update: what have you done today? what enquiries have you got back? when do I sign the lease? blah blah blah, they are SICK OF ME they can't wait to get rid of me HAHAHAHAHA therefore I am sure they are dealing with it the best they can :D

    PS having said this it still did not happen by my deadline but we are falling about 2 to 3 weeks past this.

    If you have a basic understanding of the system and who does what and when, you know the times to push your solicitor and the times to push the EA to push the vendor's solicitor.

    The wrong pressure on the wrong party at the wrong time is misplaced and pointless.

    Solicitors instructed
    Sales memorandum issued by estate agent
    Purchaser applies for mortgage
    Vendor's solicitor prepares and issues draft contract to purchaser's solicitor and seller's enquiry forms to vendor
    Vendor completes seller's enquiry forms and returns to their solicitor
    Valuation/survey carried out
    Purchaser pays their solicitor for searches
    Searches requested by purchaser's solicitor
    Renegotiation of price due to survey findings - if required
    Mortgage offer issued
    Purchaser's solicitor receives seller's enquiry forms and raises any enquiries with vendor's solicitor
    Searches returned to purchaser's solicitor
    Responses to enquiries from vendor's solicitor to purchaser's solicitor
    Purchaser visits solicitor to go through paperwork, hand over ID and deposit
    Completion date agreed between all parties
    Contracts exchanged
    Purchaser's solicitor sends purchase funds to vendor's solicitor
    Completion takes place
    Vendor's solicitor receives purchase funds and authorises key release.

  • I think nag was the wrong word. However, when I ring my solicitor to ask her to explain what's next and what's the expected timescales I don't get an answer. I have only rang 3 times in the past 4/5 weeks and I have spoken to the EA once.

    All I really want is the solicitor to speak to me to say we are doing X and I would normally expect this to take X days and to let me know if there is a hold up and what is causing this.

    LL is abroad somewhere so can't contact him.

    The searches on our purchase came back in a matter of days whereas our buyer's are taking four weeks (different county/LA) :o

  • I haven't received anything yet from my solicitor or the vendor yet and it has been over a month since solicitor was instructed.

    This may be the problem too - the landlord may be taking ages to provide information to his solicitors. As the landlord will also need to sign the contract and transfer document in person, I'd factor in at least a few extra weeks for those to be signed from abroad and posted back (when the time comes for signing).
  • We were in a similar(ish) situation to you earlier this year, but rather than buying from a Landlord we bought a New Build. This effectively meant, like you, we were not in a chain so to speak; it was just us and them.

    We put our reservation fee down in March but didn't move until June because it is a lengthy process. I was calling our solicitor frequently to make sure we understood everything and check on how things were progressing. Our biggest delay was getting our Mortgage Offer (8 weeks, what a joke! House was valued wrong somehow) which slowed things down for us, but it seems that the LL being abroad would slow things down too.

    This post was meant to be more helpful, sorry (so tired, been up hours). The jist of it is - these things do take time but your solicitor is there to help you. I rang mine one time and apologised for all the phone calls and she told me that that's why I was paying her! That made me feel much better!
