Help required with Titan Telecom and Termination fee

So we've been with Titan for over 4 years and I want to switch to a great deal with BT. the missus signed up with them from a door to door sales man.

however now wanting fibre optic I wanted to switch over to BT and set to apply for their deal.

today i've received an email from Titan Telecoms asking for £200 termination fee.

i know I know the missus should've read the contract before she signed it - but this cant be ok with OFCOM and the powers that be??

The contract clause states

" We are able to end this Agreement if you breach any of the terms of this Agreement. In particular, we are able to end this Agreement if you do not pay any invoices by Direct Debit within 14 days of the invoice being raised, or if you transfer to another service provider not in accordance with 8.1 above. If we end this Agreement due to a breach of its terms by you, then we will charge you a termination fee of £200 per line, channel or connection for each year or part-year remaining on your contract. You agree that this represents a fair and reasonable estimate of the losses that we would suffer in these circumstances"

any assistance would be greatly appriciated

  • If you agreed when you signed the contract your be liable to a £200 early termination fee ,what do you expect Ofcom to do.

    roll over contracts

    Ofcom estimates that 15% of UK residential customers are currently on rollover contracts, where you need to opt-out to end the relationship. Telecoms giant BT is the largest communications provider to offer these contracts.

    Other providers offering Automatically Renewable Contracts (ARCs) include Adept Telecom, Axis Telecom, Eze Talk, iTalk, TalkTalk Business, Titan Telecoms, and Optimum Calls.

    The changes announced yesterday (13 September) will be banned from December, bringing an end the practice of customers actively having to opt-out of ARCs, which impose penalties for leaving.

    But you would not be on a rollover contract now. Companies were required by Ofcom to stop using them, and change existing ones to contracts that did not include rollover clauses by the 31/12/2012.

    Your asking them to terminate your contract early , they are asking you to pay an early termination fee as agreed.No doubt you are aware you are only normally able to end a contract without penalty at the end of the agreed supply period.
