Notice to Keeper sent to Minor ie Under 18

Would appreciate some thoughts on this slightly unusual situation.

Excess Charge Notice issued by Local Parking Services (LPS) ltd in a pub car park.

Possible grounds for appeal on mitigating circumstances but this might be a more productive route.

The car is a Motability car via the DLA for my 16 year old son who has severe autism. SO the NTK was addressed to him. Obviously he wasn't the driver and due to his condition and extremely limited verbal skills he won't be identifying the driver or communicating with LPS.

I wasn't the driver either but I would be happy to write to them advising them to drop this for the above reasons.

    What was their trumped-up excuse for issuing the fake invoice?

    Issued for "Parking without displaying a valid ticket".

    I wasn't personally present but I'm informed that Excess Charge Notice was placed with approx 10 minutes of entering the car park ie it was there when driver returned with change,

    Don't bother with mitigation. But do write on behalf of the keeper and explain the situation, and add there has been no loss and they are breaching the Equality Act if they persist. Surely they will cancel...let us know what the scumbags do!

    This is one of the very few situations where a Lay Rep can conduct the proceedings in behalf of the Keeper - as the Litigation Friend.

    Depending on where you are based, a BMPA rep may be able to assist you with the whole process. Please PM me and I'll see if we can find someone local for you, or someone local enough.
