Please explain why you believe that if another causes you loss you can only claim for that loss if a contract exists between you?

I would suggest that the OP is entitled to some sort of compensation/goodwill payment. But from the builder, not Howdens.0

I thought that OP said the order was a trade order made from Howdens by their builder and their builders turned up on agreed delivery date and found they could not start work until the omissions were made good.
I do not understand the point about not booking a fitter until everything is on site. If it is trade order, who is supposed to check it has been correctly delivered if there is no fitter present when it is delivered? Not the home owner surely - it is the builders' responsibility. If the builder and fitter is the same person, how can they check it has all been delivered on site if the home owner has not yet booked them to come on site?0 -

B&Q (definitely). Screwfix (definitely) and Howdens (thanks to the helpful mse forum experts) all state to not book a fitter, or contractor, or schedule work until all items have been delivered and checked. By buying from them one is entering a binding contractual position on this. People can challenge this but these are the terms of doing business. Consequently, as OP paid Howdens by Direct Debit (and in advance - an unwise situation) one should ask if the order was in OP name. If so, the responsibility for checking is with OP. If the order was in the builders name then it was the builders responsibility to check the items and schedule the work to suit. Either way, OP has no redress other than to politely request a goodwill gesture should Howdens deem this appropriate.0 -
My kitchen was delivered when my builder wasn't there, everything unloaded and put in garage at speed, impossible for me to check. Turned out bits missing, bits extra not ordered and wrong colour on glass boards. Manager at Corby branch agreed to refund cost of glass boards and missing items. Instead of getting refund I got demand for extra £280!!! I know my builder had to drive over to pick up missing bits so possibly I'm being charged twice. Their stock control is dreadful. Staff helpful, manager total waste of space. Has attitude if I ignore it, it'll go away.
Do they have head office?0 -
As Howdens are a trade only supplier it is the builder's responsibility to check that what they ordered is what's delivered. It is not up to the homeowner to check or to pay extra for problems which are not down to them.0

To reiterate the excellent advice previously given by those with knowledge, and also my observations...Whose name was the invoice for this work? Whose name was on this section of the Delivery Note? It is likely to be your builder. If so, you should not be complaining about Howdens. Instead you should be kicking your builder up the backside, whilst simultaneously berating yourself for being foolish, or naive.0
