Delay in solicitor paying stamp duty

Hi everyone,
Have had a letter today from the solicitor that due to unforeseen completion system errors at the solicitors our stamp duty has not been paid by them! Apparently we will be getting a letter from HMRC demanding payment, I then have to contact the solicitor and get him to confirm payment to HMRC.
Quite annoyed as we gave the money to the solicitor on the same day they asked for it for stamp duty, on exchange, but accept mistakes happen.
Does anyone know if this will affect mine and my husband's credit scores?
Also, when should we have confirmation that property is registered at Land Registry? We completed on 26th September.
Thanks for all advice
Baby due 21/06/2017 :)

    No, it won't.

Land Registration will follow payment of SDLT.

LR should complete the registration within a few days of receipt of all correct documentation.

There's an HMRC penalty for late payment (30 days from Completion) of SDLT.

Not quite. It follows submission of the SDLT return. Any delay in paying the SDLT to HMRC is irrelevant to the registration.

If HMRC are chasing up late payment, that suggests the return was probably submitted on time, and there's probably been no delay in land registration - but something for the OP to ask their solicitor.

Thanks for the correction. I assumed in most cases payement accompanies the SDLT return, but yes, if the return is submitted without (correct) payment the registration could still take place.
  • Thanks for the advice - I'll ring the solicitor this week and check if he has submitted documents to the land registry.
