notice of assignment and transfer

Hello,

I'm purchasing a leasehold flat. The exchange is completed and completion is due soon. I have now got the completion statement from my solicitor. In the statement they are charging me separate fees for notice of assignment and transfer as below

Fee due to Landlord for notice of assignment £ 200.00
Notice of charge/transfer- freeholder fee £ 216.00

I always thought that the freeholder is also the landlord and the notice of transfer is same as notice of assignment. I'm wrong here?

    Is there a separate Management Company to whom notice is also required? It may just be written down poorly. That seems the most likely but your solicitor should explain this to you.
  • Well I asked them to list down the name of the relevant parties however they are just pointing me to loads of document and not listing down in a simple email.

    Also I see below in the management pack so seems there is no separate notice

    7. Notice of Transfer

    Notice of Assignment and Charge to the freeholder must be served on the freeholder direct, and not to <Managing Agents name>. Confirmation would need to be obtained from the freeholder of their fee for the Notice. However, we would be grateful if you could provide <Managing Agent Name> with the purchasers, and actual date of completion.

    So from above it seem that Management company doesn't need any other notices

    These look like they are 2 separate notices both served on the landlord (freeholder) - one is a notice of charge and one is a notice of assignment of the lease. Each notice attracts a separate fee unfortunately. I think your solicitor has worded it badly and you should ignore the word "transfer". Definitely query it again though to double check as it's quite a high notice fee.

    Yes, I too suspect one is notice of the change of owner (assignment) and one is notice of Charge (mortgage) on the property.
