Can anybody tell me what my rights are !!
I purchased 2 packs of out of date chilled scotch eggs from a large supermarket today, I was told by the customer service to go get 2 more packs and was given a refund, I asked to speak to a manager when he arrived he just apologised and asked me what I wanted from him he went on to offer me flowers or a £5 gift voucher this I refused and said I was taking it further his reply was the email would in fact come back to him instore for him to deal with .
I thought it was a criminal affense to sell out OOD food ..

It isn't criminal, you have no rights, he put you in a better position than you were in before,
You got the goods and also a refund. He didn't need to do this.
He tried to make it better still by offering you a fiver. He didn't need to do this either.
Did you purchase them, get them home then take them back to the store.
Was the date on the pack Best Before or Sell by, either way,
and what is it that you are hoping to achieve.make the most of it, we are only here for the weekend.

So you want compensation because you failed to read what you were buying?
Your only rights are refund or replacement which you were offered as well as a gesture of apology

How about they refund your money, send you a new one at no charge, give you £500 as a bit of compo because you can't read, close the store and have the manager shot.
Would that be satisfactory?Understeer is when you hit a wall with the front of your car

Hopefully, by now you are feeling a bit foolish.

I probably was a little foolish by not checking the dates but after been up all night with a terminally Ill relative the last thing on my mind was to check if the products in my trolley was all in date. I wasn't acually looking for compensation like I told the store ..... I thought it was a criminal affence to sell out of date prepacked chilled food, Forgive me if I'm wrong. Thanks again :-)0

It probably is an offence, but most likely, they just made a mistake and clearly went out of their way to make it up to you.
If you think it was intentional and this is a an ongoing issue then inform Trading Standards, if they get more reports they may look into it.
Probably a better place than a web forum about TV.0 -
Even if it is an offense you're not in any position to prosecute them.
Report them to trading standards - unless they are serial offenders they'll likely just have their processes checked (remember mistakes are allowed!) and told to keep up the good work.Thinking critically since 1996....0 -
