They can't, it's not in their gift. Phone the CQC and the local authority, who will be paying the fees of some of the residents.As a collective they agreed that in order for them all to keep their jobs that they will give up the increase..................

I've had this with one of my sons working in animal care. He was having to work 10 hour days for £45 a day (before NI deductions) . When it comes to a choice between that or nothing (not entitled to benefits due to savings) it's the only way he could get experience. he told me everyone there was paid the same. The final straw was when they refused to pay him holiday pay after he had worked there for a year with no break !
Once he was ready to move on he has reported them, nothing much seems to have happened though, it's not a quick process. There are plenty more youngsters queueing up for these jobs too so there's no need to offer more money even if they could afford to.Decluttering, 20 mins / day Jan 2024 2/20 -
Thanks for all of the replies. I'm going to call my dad about it tonight and put some of the things you guys have mentioned. My step mum doesn't know my dad has told me I don't think. I know they can't legally 'opt out' but I suppose I hadn't thought of it in the terms of they are being essentially blackmailed. I'd also not thought about about what else he could be scrimping on especially with the nature of the business. I'm not sure how long she has worked there definitely was there the Christmas before last because I rememeber she worked Christmas Day .0

The employer could be in serious trouble if he doesn't pay the NMW.
If he attempts to dismiss anyone this would be automatic unfair dismissal regardless of how long they have worked there.
He can't dismiss anyone but naturally he would be entitled to make members of staff redundant. If someone has been working there less than two years they would be entitled to nothing.
He is also entitled to sack someone if they have been there under two years without reason unless he has sacked them for a protected characteristic.
