    Unless it specifically says this in your contract this is not true. Commonly your employer would tell you to use holiday days for this, which can be unpopular if people want holiday at other times. They are probably thinking to be nice by offering alternatives, either a difference place of work, or working on a different day. Have you asked about taking the days as holiday, or unpaid leave?

    Yes unpaid leave and holidays are apparently not an option,the only holidays bin honoured are the ones that was pre booked beginning of the year

    That doesn't make any sense. If you have holiday left and there is enforced holiday (which is legal), then they simply take the shutdown out of your holiday.


    The bottom line is that the employer is enforcing holiday. Which they are allowed to do. Setting aside the fact that the answer is yes - they can do this - I am not clear why you think this is a problem. You have the option to work anyway, to take it as holiday, or to work it back if you don't have enough holiday left. Are you expecting to get paid for extra holiday? Because that isn't a right.

    You can say it as many times as you like. It does not make any difference. You get XX days holiday a year which are paid. Full stop. WHATEVER happens this does not change. So if they pay you for days over Christmas which are not holiday, then you must work them back, even if "working them back" is taking holiday some other time.


    It seems your question is simple. The employer has decided to close over Christmas. Must they pay you for the extra days? Answer - no. Your leave entitlement is determined by law (or contract if better). That is your leave. One way or another.


    If you work these days back - you still have holiday left. If you have no holiday left you may work them back - or work at another location on these days.


    It seems that you have a lot of options. So what is the problem?

    The op is saying the only option is to work alternate days/location and they are not able to take them as holidays.

    The reps/council need to told to sort this out.

    Some employers if they are closed Xmas - New Year, they give their employees 3-4 days holiday on top of their annual leave allowance to book off the closed days and still have round weeks to book off rest of the year. My Dad had that with various employers in the past - now retired.

    With these employers, they close on Xmas Eve (Tuesday) . Some employers close at lunch and still pay their employees for the full day. As 25,26th are public holidays they are paid then 27th and 28th is the weekend. Then the annual leave will be paid for 29-31. NYD is a holiday as well. As 2nd Jan is on Friday, some employers may simply keep closed as not worth bothering to open up as if they did, many employees will try to book it off. Hence why 3 or 4 days of annual leave added.
