Highview Parking

Hello, I've not posted on here before so please be gentle with me. On 14 October I parked in a free car park I have used before and where parking was always free for two hours. I had taken my daughter to Specsavers for a test and new glasses, and we left just before the two hours were up. As Highview Parking states, 1 hour and 56 mins. Next thing I received a Charge Notice from HP advising that I was parked there on 14 October for 1 hour 56 mins - in violation of Ts and Cs displayed on the signage. However, it does not actually state what the violation was. I wrote to them requesting further information. I haven't been back to look at the signage as it's not convenient and I would never usually park there - I only parked there on that occasion as I'd taken my daughter to the nearby optician. Today I have received a Charge Notice reminder Do not ignore. They have not responded to my letter. So I have sent them an email attaching a copy of my letter and asked again for an explanation. I have also written to my MP (Nick Clegg, for what that is worth!) because I really do not believe that DVLA should be allowed to disclose motorists' details to private parking companies such as this. If they want to charge for parking, then they should charge for parking up front and legally instead of in this totally underhanded way. Sorry this has grown so long but I intend to fight this charge and just really wanted a little friendly reassurance! Thank you very much for reading. If you do not feel that you can offer any friendly reassurance, please do not respond. Thanks again.

  • You've jumped the gun, and probably owned up as the driver in doing so.

Read the NEWBIES thread on this forum, so you know what to expect and how to act when the inevitable rejection comes from Highview.

Nick Clegg, if he responds, will trot out the usual claptrap, so don't expect any progress there.

Just appeal at POPLA stage and win like we all do:

It's not too late, even though it sounds like you have named the driver which wasn't a great start (sorry, the keeper had more appeal points under the POFA 2012, that you now can't use if you said you were driving). But as long as your letter to them was a challenge then they have to send you a POPLA code, and the NEWBIES sticky thread near the top of this forum, is where you find 'How to win at POPLA'.

I am just concerned that you said you wrote 'requesting further info'. That's NOT a challenge and Highview have before now, swerved sending out a POPLA code if they think someone 'has not appealed'. You should follow it up saying it's clear the charge is not a genuine pre-estimate of loss and so you expect a POPLA code.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
