  • There must be some law (well I do hope so) about having "mental capacity" to make effective decisions.

    In your position, I would be looking to hunt out such a law.

    There is, but unfortunately for the OP decisions/documents signed have to be taken when the person is 'compus mentis', ie before the problem arises. Once the problem has arisen, the courts have to be involved.
