Car door hit in car park - who's fault?

so its the drivers fault for driving into a car park spot ?. Dont know about who would win if it went through insurance but arent you supposed to check its safe before you open your door ?.

its the slimmest of margins who is at fault if you have opened the door just as he pulled into space its probably yours, if he was driven into a open door its his fault

it is physically impossible to leave a metre on either side when parking in most car parks. I think that MOney must have thought the other driver was just driving past

Its hard to leave a cm in some car parks

You open the door into the path of a correctly proceeding vehicle - you're at fault. A vehicle hits a static object, your door, then the other vehicle is at fault.

As the TP was also trying to park at the time then you may be lucky and get a 50/50 but thats really best case for you. Could end up being 100% your fault if your insurer doesnt want to fight and particularly if there is no damage to the TP vehicle right at the front, damage to the side of the front wing rather than the front end would suggest it had already gone past level when you opened the door.

The other car definitely has an indent directly in front bumper, where it hit my door.
