Signage has been changed since my NTK arrived

Hi have recently received a NTK from Care Parking for parking overnight in a free tram carpark outside of tram operating hours. The charge is £100 for parking in a free car park!!


The driver is a regular user of said tram car park and had never seen any signage to this effect so obviously we went to check out the signage once the NTK arrived as we were convinced this must have been a mistake. It appears however that new signage has been put up since the date my charge was made.


I have appealed to care using the template in the Newbie thread and am fully expecting this to be rejected. My concern is that I cant prove in the POPLA appeal that the signage was inadequate at the time as they have put new signs up. Is this an issue? I think it kind of proves the signage was inadequate by the fact that they've replaced and increased it - is that a point worth making??


I'm thinking the main grounds for the POPLA appeal is GPEOL as how can you lose money from a free car park but the signage was def inadequate at the time too.


Finally, thanks to everyone on this forum - I have spent hours pouring over all the helpful advice

    Not an issue to worry about as yes, you should win on GPEOL in the end as it's a free car park - there simply is no loss.

    Q. Could tram car parks fall under railway byelaws? (Obviously there would have to be signage accordingly).
  • On Google streetview you might still have the old signs if you need that.
  • Might as well still make an inference that the signage appears recent in your Popla appeal and let the PPC defend it.
