Debt Free Direct Causing Problems In Closure of IVA

To cut a long story short been in an IVA for over 2 years with Debt Free Direct.

For the past year they have been a bloody nightmare.

Wanting an increase in my monthly payments making the IVA unaffordable I had to cancel in July.

They took my DLA as income and were using it to pay off my debts which I was furious about.

Prevented me from having essentials like dental treatment, and other things.

At the start of the IVA I repeatedly told them I had no PPI on any of my debts as I didn't qualify being on benefits.

Today I have been sent forms from Equity in Finance wanting to chase for PPI!!

I cannot believe this!!

I told DFD in an email last week that there is no PPI and they are wasting there time in chasing things that aren't there!!

I think they are dragging there heals over this and making more problems so as not to close the IVA down as they are fully aware I need the failure certificate to apply for a Debt Relief Order.

What can I do to make them see sense about no PPI being on the debts?

Am at the end of my tether with them!!

  • Put in a formal written complaint to them.

    But it is sensible for them to check for PPI, lots of people have found their IVA discovered PPI that they had no idea they had.
  • Trouble is I am fully aware that there is no ppi thats the point!!

    I had taken my IVA with debtfree direct over 7 years ago my last final payment was 2 years ago In July 2012. I know my case was on going with PPI I had letters confirming I can close my IVA while my PPI was still being sorted out. This has not seem to be dealt with and has upset me. My case now is ongoing and they want to review my earnings again which has annoyed me and because this case should of been closed now not in 2 years later.

    I am not sure what I am going to do they are sending a agency on behalf of them to collect my pay slips bank statements for last 3 months.
  • I'm not surprised you are upset. I think you should complain to the regulator about DFD's excessive delay.

    But you may as well supply the pay slips etc, this could be the last check they are making before final closure.

    I have sent a very lengthy detailed email of complaint to the Insolvency Practitioners regarding Debt Free Direct's behaviour so far and the fact that they are deliberately using PPI claims to delay in closing the file down.
  • I sent a lengthy email to the FAC in October regarding DFD's recent behaviour and they have not as of yet replied.

    I am also still waiting to hear back from the Insolvency Practitioners as well.

    Is there any way in which I can get DFD to accept that there at fault in the IVA failing by the behaviour and to close my IVA down without having to wait over 6 months!?
  • I have received a response from the Insolvency Practitioners this morning.

    They are going to send my complaint directly to my IP regarding Debt Free Direct's behaviour about making the IVA deliberately unaffordable.

    I have demanded all of the money back as I have concerns that what I have paid in is only being used to offset their fees and to which has made no real dent in the debts that were listed.

    Am not positive to getting my money back back at least they accepted the complaint!!
