dla is not accountable for tax credit purposes at moment, but if you get high rate awarded I think you get more allowance on your accountable income as you are classed as higher needs. Declare anyway as it certainly wont harm the outcome.
  • CTC - disabled child element:
The relevant qualifying benefits here are disability living allowance (DLA) and personal independence payment (PIP). DLA is the qualifying benefit for children up to 16 and PIP is the qualifying benefit for young persons aged between 16 and when CTC for them ends. A child or young person qualifies for the disabled child element if they:
    • get DLA or PIP, any component at any rate (or would do apart from the fact they are in hospital); or
    • are registered blind, or have come off the blind register in the 28 weeks before the claim for CTC is made.
CTC - severely disabled child element:
A child or young person qualifies for the severely disabled child element if they receive:
    • DLA highest rate care component
    • PIP enhanced rate daily living component
A child or young person who qualifies for the severely disabled child element will also qualify for the disabled child element.

Just got my award through for my daughter, she has been awarded middle rate care and lower rate of mobility. When i phoned tax credits they filled out a referral over the phone, and told me i will know in 6 weeks if we are entitled to anymore tax credits,is this standard procedure for adding DLA to your claim.

    thanks

Yes. There was previously a great deal of fraud with the disability elements of tax credits so all cases are checked first with DLA before paying.

Thanks, i did offer to give her the ref number that was on they award letter, but she said that was only for me,if i wanted to contact the DWP.

is it a fixed amount you get for the disability element or does it depend on your income?

Tax credits is calculated by awarding elements that are set amounts (other than the childcare element).

    https://www.gov.uk/government/publications/tax-and-tax-credit-rates-and-thresholds-for-2014-15/tax-and-tax-credit-rates-and-thresholds-for-2014-15

They calculate the total you are entitled to then taper that based on income. Child tax credits starts to reduce if income is over £16,000 (approx).

so the disabled child element is £3100 per year,so this will taper based on our income??

Also is it backdated to when she was awarded DLA,or 30 days from when i informed tax credits?

    thanks
