These Offer Terms and Conditions apply to you so far as the law permits so please read them carefully.

1. Marks & Spencer Financial Services plc, Kings Meadow, Chester, CH99 9FB is the “Promoter” of this prize draw. M&S Bank, a trading name of Marks & Spencer Financial Services plc.

2. These Offer Terms and Conditions apply in addition to the M&S Bank Credit Card Terms and Conditions. The M&S Bank Credit Card Terms and Conditions will continue to apply as normal.

Can I enter the prize draw?

3. All customers who use their M&S Credit Card to make a purchase in accordance with these Offer Terms and Conditions are eligible to enter the prize draw.

4. You can only enter the ‘Win back your festive spending’ prize draw and win the prize if you are 18 years old and above and are a UK resident (excluding Northern Ireland, Channel Islands and IOM).

5. This prize draw is not open to employees of Marks and Spencer plc and M&S Bank.

How does the prize draw work?

6. The prize draw opens on 6th November 2014 at 00.01 and closes on 31st December 2014 at 23.59 (the Campaign Period).

7. To enter the prize draw all you need to do is spend on your M&S Credit Card. Eligible customers will receive one automatic entry per retail spend transaction (excluding Cash Advances and Balance Transfers as defined within your M&S Credit Card Agreement Terms) made during the Campaign Period.

8. Customers applying for the M&S Credit Card, who are accepted within the Campaign Period will be awarded 5 entries into the prize draw. After they receive their M&S Credit Card they will be eligible to receive one automatic entry per eligible retail spend transaction made during the Campaign Period.

9. To opt out of the prize draw, please confirm this in writing to the Promoter at Win back your festive spending, M&S Bank, Kings Meadow, CH99 9FB to arrive before 31st December 2014 and your entries will be withdrawn.

10. The winner will be selected at random by an electronic process on 11th February 2015.

The Prize

11.. There is one ‘Win back your festive spending’ prize, which is based on all eligible retail spend made on the M&S Credit Card during the Campaign Period. M&S Bank will pay the winner a cash prize equalling the winner’s total eligible retail spend on their M&S Credit Card during the Campaign Period, up to a maximum limit of £10,000. In the event that the winner’s total eligible retail spend during the Campaign Period is less than £500, M&S Bank will pay the winner a cash prize of £500.

12.There will be no prize alternative to the prize stated.

13.. Sale, transfer or exchange of any part of the prize by the winner is strictly prohibited. Any attempt to sell, transfer or exchange any part of the prize by the winner will result in the prize being withdrawn by the Promoter.

14..If you are selected as a winner, you have the right to refuse the prize.

15.. The winner will be contacted by telephone or letter by 5pm on18th February 2015 with details of the prize and how it will be paid. If, we are unable to contact the winner by this date and time, or if the winner refuses the prize, the Promoter will select an alternative winner at random by an electronic process.

16. The winner agrees to take part in any promotional activities reasonably requested by the Promoter.

Legal Information

17..The Promoter and its group companies will not be liable (to the extent permitted by law) for any loss or damage arising out of organising or holding this prize draw or as a result of your participation in the prize draw, or if the prize draw does not run as planned. This clause does not seek to exclude the liability of the Promoter and its group companies and Contractors for (a) death or personal injury caused by their negligence, (b) fraud or fraudulent misrepresentation, and/or (c) any other matter for which it would be unlawful for them to exclude or attempt to exclude their liability.

18. It is the winner’s responsibility to comply (at their own expense) with any laws requiring payment of any tax, duty, levy or similar impost relating to the award of any prize, and M&S Bank or HSBC Group shall have no responsibility in this respect.

19. The Promoter can cancel the prize draw at its discretion and without incurring liability as a result.

20. You consent to your data being stored, transferred and processed by the Promoter and its group companies, and to contact you if you win a prize.

21. These Offer Terms and Conditions and any disputes arising from them are governed by the laws of England and Wales and the jurisdiction of the English courts.

23.. The company’s decision is final and no other correspondence will be entered into regarding the outcome of the draw.
