Parking Eye County Court Claim Form

I stayed half an hour in a Parking Eye car park but didn't buy a ticket as the machine was out of order and I couldn't see another from where i was stood. They are now taking me to court (I have a County Court Claim Form). I refuse to admit to the full £100 (£175 including costs) but I'm worried I'll get a CCJ against my name if I admit to some and the judgement goes against me.

    Do you have a question?

Not sure why this is in the credit card forum, but read the newbies thread here for advice.

  • You will not get a CCJ on your credit records against you simply because you lose a court case. Its only if you lose and then dont pay within the 30 day time limit that it goes onto the CRA record
  • Oops! sorry, wiogs I'm new and confused! Couldn't work out how to add a new post.

Thanks for your help. I'm probably going to admit to some but challenge the whole £100 as it's extortion pure and simple.

InsideInsurance - you're sure that I'll only get a CCJ if I don't pay then it looks like the best way.

    What?

Read the newbies thread. You admit nothing and pay nothing.

And you won't get a CCJ

So have you found all the links in post #5 of the Newbies thread - that will get you towards writing the defence.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • Yes thanks! Do I just send the N9B form before 28 days from service?

You don't 'send a form', you acknowledge it on MCOL online then immediately work on a decent defence summary which you must then submit (online via MCOL again) no later than 28 days after service of the court papers. You don't get anything else arrive in between.

Please read the links in post #5 of the Newbies thread. A defence is not 'filling in a form'.
