Yes I've looked through those templates but there doesn't seem to be one that matches my criteria in that the machine was out of order.
PE don't even acknowledge this in the letter they sent me.0 -

Forget machine out of order, particularly as you can't confirm there were no others.
Your appeal will be based on the No GPEOL, signage, unreasonable charges etc as in many of the successful appeals in the NEWBIE links or the latest POPLA DECISIONS sticky posts.0 -
"parking penalty charge". So the hospital are admitting it's a penalty. As for not being able to do anything, It seems the tail is wagging the dog. The hospital appointed PE to do their dirty work, they should be able to tell them to drop the case. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

That's because using, "machine out of order" will lose you the appeal. The other points in the NEWBIES thread will win.I married my cousin. I had to...I don't have a sister.

Could I respectively suggest you re-read the Newbies thread ? You might spot the point that mitigation doesn't work !!!!!!!!!

I think you are rather confused.
You are not dealing with reasonable people.
There is a method to win that is just as deceptive as them.
Forget this rubbish about the machine and use the GPEOL template.
Then send to POPLA, once they see the template they wont bother sending in any info to POPLA, it takes too much office space.
But you must drop this nonsense about the machine or you will lose !I do Contracts, all day every day.0 -

I emailed the hospital and they said:
Thank you for contacting the Patient Advice Liaison Service (PALS). We received your email on 10 November 2014. We are sorry to learn that you have received a parking penalty charge (PCN). However, we would like to assure you that you have followed the correct process by appealing against your parking charge notice directly with ParkingEye. Unfortunately, we are unable to intervene on your behalf in respect of the notices that have been issued.
We would like to assure you that Parking Eye is able to check the system to retrieve any information that has been recorded on each individual machine on site, and can carry out diagnostic checks on all payment machines to establish if they are running correctly. Your comments have been passed to the Car Parking Management Team. If require any further assistance please write to the Car Parking Manager at Queen’s Hospital or alternative email carparking@burtonft.nhs.uk.
This is exactly what I received from PALS at Barnet General Hospital. It looks like Parking Eye provide them all with a generic response. The hospital own the land and they are the client and as far as I am concerned they can tell PE to overturn the penalty notice, but they don't seem to want the hassle."You should know not to believe everything in media & polls by now !"

I recently had to use my local hospital having had a fall. I parked up at the bottom end of the car park and went to use the machine to obtain a ticket. The machine located there had an "Out of Order" sign attached to it.
I didn't look for a further machine (it's only a small car park but possible another machine at the entrance) and proceeded to limp into the hospital. 1 hr and 22 mins later I emerge on crutches and make my way back to the car.
2 weeks later I got a letter from Parking Eye about being parked without a ticket. I went online and submitted an appeal pretty much stating the above, and also attached pictures of the x-ray and paperwork I was given on leaving the hospital.
I got no "automated response" email back as you usually do when submitting an online form so gave it a few days and tried to chase it up. I had no luck in trying to talk to a human... so I submitted a query on the website again.
Last week I get 2 letters. One is a copy of the original one I was sent saying I'd parked without a ticket etc. The second was a letter thanking me for my correspondence. Parking tariffs apply etc... and if I want to make a payment then call / visit the info given or if I'm appealing they need valid evidence.
I've already submitted this to them!
So again I'm stuck in a loop trying to find a human at the end of the phone to go over this!
Has anyone got a contact number other than 0330 555 4444 which is the payment number.
TIA
Hi Paul, I’m very interested in hearing more about this as part of my research for a TV programme. Please get in touch at: katieloweth@gmail.com0 -

Hi Katie. We advise OPs not to respond to unsolicited requests for contact with new (or low post-count) posters, especially where 'throwaway' gmail/hotmail email addies are provided. PPCs have in the past 'lured' OPs into discussing their problem with them off-forum, and have subsequently directed them incorrectly, and to their (costly) disadvantage.
I have googled your name and certainly there are many references to Katie Loweth Journalst, so if you could please provide a few more bona fides (nature of the work you are proposing and for who, for example) to give the OP some confidence to make the initial contact with you.
Sorry for the uber-cautious approach, but this is a murky business we are dealing with on this forum. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
