Cancelling a Contract for Travel

I booked a trip on a website on 06/11/2014 and paid a £290 deposit I then released the next day that I had mixed up my dates and couldn't go on the trip so I called to cancel immediately.

They told me that I could cancel but would not receive any of the £290 back!

I did some research and realised that I could cancel the contract within the 14 days colling off period and get any deposits less admin fees refunded. I emailed them and they have said that they still will not refund me!!!

is this correct?

they did nothing at all to deserve this money surely they cant just keep it it was less than 24 hours!!

how is that fair??

please let me know what I can do!

    which company did you book it with and can you link to their T&Cs?

    Where did you get the 14 day cooling off period from ?
    If it was from the CCRs http://www.which.co.uk/consumer-rights/regulation/consumer-contracts-regulations then holidays / flights fall under the exemption of the right to cancel :

    "Exemptions There are some contracts where you won’t have a right to cancel a service. For example, hotel bookings, flights, car hire, concerts and other event tickets, or where the trader is carrying out urgent repairs or maintenance."
  • I googled 'contract law' thats where I got the 14 days from.

    I have read the ts&cs and it does say I loose the deposits but I thought I was still covered due to the 14days cooling off period.

    it was for hotel only no flights

    So thats it then I just loose my money?

    Hardly seems fair :(

    From what I have read...... does this mean that If I were to take them to court (Money Claim online) I would be quite likely to win as they would not be able to prove they had actually done anything for the money...

    ie they would not be able to justify retaining the full £290.00?

    Or am I completely of base?
