DPS Scheme

Good morning,

I recently cancelled the contract with my estate agents due to an extremely poor service amongst other things. I have kept the tenant in and requested they transfer the deposit into my DPS account. I now know that the agent has never placed the tenants deposit into the DPS scheme, has lied several times about transferring it and has now moved stores. Can anyone advise me on who to complain to?

Any advise would be appreciated

    Oops you're ultimately liable - I would be inclined to lodge the correct amount with DPS and provide the tenant with the prescribed information pronto - then sue the agent

    Is the letting agency a member of ARLA or another regulatory body?

    As Hump says, ultimately the responsibility to protect the deposit is yours so get the money protected and the PI issued tout de suite.

    How can the tenant transfers the deposit into your DPS account?
    From what you say they paid it to your ex-agent who kept it.

    So you should demand the deposit from your ex-agent.

    If the deposit was paid to the agent and held by them, they are also liable for the non-compliance penalty.
    In any case, they certainly breach they duty of care towards you so are liable to compensate you should you be sued.
