Used Subaru: Bought yesterday- dud today help!

Hi Everyone,

I wonder if anyone could advise. I brought a used '59' Subaru Forester yesterday from a Subaru main dealer. 32K miles and outwardly very tidy. Full service history etc.

I paid with a Visadebit card. The money has not yet left my account.

It drove home OK but today I went to drive it and there is a dreadful noise coming from the transmission. On investigation I found a recent receipt at the back of the glovebox for a transmission rebuild from the dealer I bought the car from.

The vehicle came with Subaru breakdown cover (covered by the AA) who came out advised not to drive the car and also found an oil leak near the transmission. They are taking the vehicle back to the dealer on a wagon as 'Subaru assist'.

It is covered by a 1 year warranty so I guess it will get fixed (at least temporarily) but my question is:

Can I simply return it and get my money back?

I am pretty sure that the car is a proper lemon.

    The Sale of Goods Act states that the buyer has a reasonable amount of time to inspect the goods to ensure they conform to contract when buying from a business. If the goods are found to be faulty before acceptance occurs then the buyer can reject them for a full refund. 24 hours is certainly within a reasonable period.
  • Thanks for that. A great help. The vehicle is now back at the dealer. The salesman seemed to think that it was reasonable to give a refund but needed to speak to his 'manager' on Monday. We shall see.

    I suspect they will opt for path of least resistance and refund, they can then have it repaired and resell it. Should be a lot less hassle for them in the long run.
