Firstly I apologise if this is in the wrong section.
My girlfriend upgraded her mobile yesterday at carphone warehouse, she went for HTC one m8. She was undecided on either this phone or iPhone 6.
During the sales pitch in which they were trying to push her towards HTC (she was upgrading from iPhone 5) they misinformed us firstly about storage of the HTC. They said unlike the iPhone the HTC has the full 16gb of usable storage. This we found out later that the HTC only has 10gb of usable storage not 16gb.
Secondly during the sales person pushed my girlfriend to paying for all her data to be transferred from old iPhone to HTC. They insisted everything would be transferred including photos, videos, contacts etc. Which was one thing she was very keen on as she didn't want to loose photos. Tbf most of the data was transferred but what's app media was not meaning she lost all photos, conversations etc within WhatsApp. We were also told that icloud backup only backs up the last 6 months which was another reason she went with HTC.
Now my question is can the mobile be returned and switched for a iPhone? According to carphone warehouse website it doesn't come with a cooling off period as it was purchased in store. But due to being misinformed does she have a right to return?
I was there at the time and heard these things he claimed about the HTC

You can complain to the shop's manager that you were "misinformed' about the features of the 'phone. It will then be up to him or her whether to allow you to change your mind. You have a better chance of success if the 'phone is still in it's original packaging, otherwise I doubt you'll have much luck.
In future, I recommend you research potential purchases yourself before committing.0
