!!!!!! - ESA WRAG - not even had 6 JC appt yet but sent letter requesting sicknote ?

    Why would your money go back to £70 per week again? You don't have another period on the assessment rate, even when you are reassessed, that only happens once at the beginning of the claim.

    really ?!

    so if i get *re-assessed and they say i am totally fit for work (0 points)...

    (*word used as this is my first time through the procedure currently and have only been assessed the once)

    and i appeal - i will remain on the current rate of ~£100 up to a decision at tribunal ?.

    also, if they were to rule in favour of atos - i don't have to pay any money back do i ?

    because i would have to auction off a kidney or something!

    If you are found to be fit.
    ESA will stop.
    You need to then request a mandatory reconsideration.
    This should take - hopefully a couple of weeks - though in practice, it may be a lot longer.
    Once the MR is done, you send the notice that you've been sent that it's been turned down to the tribunal, and say you want to appeal.
    Once that happens, the tribunal sends a notice to ESA, and then you can ask to have your ESA resumed at the appeal rate.

    (you need a medical note for the period until your appeal).

    You can also claim JSA in this time in between which may be your onlysource of income if MR takes a while.

    just rang them, really rubbish lady.

    she said i needed a sick note because the computer said so and that i should go travel to my doctors within the next few days and go get one or else i wouldn't get payment.

    "but you don't need to send sick notes when you are in the WRAG group ?"

    - "yes but your sicknote has expired"

    so i asked if i was not in the WRAG group anymore?, so she said that i was but my sick note had expired and i needed a new one.

    so i said "but you don't need to send sick notes when you are in the WRAG group ?" and had not heard ANY notification to the contraty and that "you don't need to send sick notes when you are in the WRAG group" amd please tell me if the next payment is on hold; she didn't tell me, only pass my information on to a colleague.

    well that's 30 minutes of my life i will never get back

    ....waiting a call back before noon.
  • just spoke to REALLY nice lady,

    they have rolled it back another 24 months and didn't require the sick-note, as suggested here!, the 12th of november did turn out to be 24 months later then the start of my claim or some occasion that i now don't care about, which prompted the letter.

    what a massive relief !!!,
