Reclaim charges while in dispute over insurance?

Hi,
My mum took aout a LloydsTsb loan years ago, with loan protection. She later got cancer and they are refusing to pay out, as apparently she is not covered according to the terms of the protection plan. They were getting really nasty with phone calls, letters, etc because once she couldn't work she couldn't pay. She was a nurse, so this is currently being dealt with by the Association that deals with ex-nurses (can't remember the name, it'll come to me at 5 a.m. when I don't need it :rolleyes: ).
Anyway, they have been taking the loan money from her account, thereby sending her into an unauthorised overdraft, then charging her for the privilige (sp?).
My question is, can I make a start on reclaiming these charges while they are still arguing about whether or not the loan insurance pays up?
I am so furious they were harassing her when she has got a diagnosis of terminal cancer :mad: . B*stards.
