The great thing about the facebook pages is they are local, so it gives you the opportunity to go and see the item touch it, test and check it before parting with your cash. At least then when you receive the item and its faulty there is no need for returns etc. If some people choose not to do that correctly thats not the fault of facebook now is it

  • What type of battery is in the thing?
    If it's a small lead acid one, there is a reasonable chance that this will be knackered due to it being left discharged for a couple of months.
    Basically what happens is that a coating forms on the plates in the cells during normal use and recharging gets rid of the coating (this coating is called sulfation). If left discharged for too long, the coating hardens and ruins the battery.

    A sulfated battery may appear to be charging but will have very little capacity.
    If it is a lead acid battery, you need to test it by charging it up then putting a load on it to see if it can provide a reasonable output. Simply measuring the voltage with a meter won't give a true indication of the battery condition.

    Most people will only buy collection only items locally, obviously. Whether that's ebay or whatever.
    If people sell faulty items deliberately it's certainly not right to blame the buyer , it is the seller who is the scammer.
    If not sure what you mean about" when it's faulty there's no need for returns"?!!
    I don't think anyone mentioned " blaming " facebook.

    Based on the provided info and the promises to refund, you would win in court. But like others have said winning is only the first step, instructing bailiffs etc all cost you money (recoverable) but if they wont pay then there is nothing else you can do, they get a ccj but that's about it, you get stuck with the court and bailiffs costs.

    I meant the fault of facebook as in the selling pages hosted by them. the point about buying something locally is that you know its local when you look on your LOCAL facebook group so sellers are advertising to those that are LOCAL unlike ebay which advertises to the masses. Obviously for a low value item you would only bid if it was local if it is collection only but delivery maybe an option.

    The point is if you have something delivered you can't test it, if you want to return it you have to post it back. If you collect there really should be no need for any return because if it doesn't work when you go there to try it you dont buy it or you get it to a price your happy to pay to take a chance.

    Its funny you how you call the seller a scammer, they sold something stating it hadn't been used in months prior where it was working, it was sold for less than the market value of a working one based on that and no charger. You've implied they knew it was broke which you can not know.

    The only way to be sure you aren't buying something faulty is to test it, which when you collect something is your chance to do so.

    Agreed i think the OP would win as the seller has offered a partial refund, they haven't said it was broke but offered a payment towards repair. But you cant get blood out of stone and we dont know the sellers circumstances so the OP could be further out of pocket unfortunately.

    Personally I would keep contacting the seller and try to get as much back as you can, as someone else stated it could well just be the battery that needs replacing and the toy would be good to go again.

    I'd definitely have a punt at a letter before action. Might scare them enough to cough up. I got a refund from a scammer who sold my son a ticket for the Reading Festival that he never had. I found his father's address by stalking him on Facebook and sent the letter there. A cheque from the kid's father arrived within a week. I never had to follow through with the court.

    Might it be worth trying to get the toy fixed?

    If you buy things to collect on ebay, you simply do a search for goods eg 5 miles from your home. Generally, most people wouldn't use ebay looking for something to collect across the whole uk,
  • Thanks for all the replies.

    The main reason I was going to chase them was because they promised a refund and then went back on that. I wasted 2 weeks waiting for them. When I could of been doing something about it.

    I have given up any attempt to recover the money. I want nothing more to do with them. I have now fixed the item. Basically looks like it's been stored outside in the rain. Many corroded connections and compartments full of water.

    I was fully aware of the chance I took buying this. I never had problem with that it's just the lying I can't stand. Still they have to live with themselves not me.
