washer dryer

purchased a washer dryer in September 2012, 11 months after it packed up and as it was still under warranty they came out and fixed it free of charge. now i wasn't happy as it took weeks for it to be done so as an apology extended my warranty an extra year. forward 7 months and it breaks down again. this time they come out and replaced the drum.now its packed up again same error as before but as its out of warranty they have refused to fix it but have offered me a new machine at a reduced price.

what are my rights i quoted the soga to them but they seem to thing i have no rights as the machine is so 'old' (as they put it).

    How much did it cost and how much have they offered you towards a replacement?

    OP, who are the 'they' you refer to?
    The manufacturer or the company that sold the appliance to you?

    Do you understand that any rights you may have under SoGA are with whoever sold the thing to you?
    Have a read of MSE's Consumer Rights guide for more detail.
  • the machine cost around £400 they have not told me how much they are willing to discount a new one by. just that they will take into account the age of the machine and service charge paid when and if i decide to take them up on their offer.

    they have said under the soga as its older than 6 months it means i have to prove it was faulty on day of purchase.

    the manufacturer. no i did not understand that as i tries them first and they told me i had to contact the manufacturer.

    This pretty much true although its a bit more complicated as there no set time limit just states a reasonable period of time.

    Here's a short extract from that article I mentioned:
    Know who's responsible

    When returning items, beware shops trying the oldest trick in the book: saying they're not responsible for the shoddy goods and you must call the manufacturer. This is total nonsense!

    If a company fobs you off by saying “go to the maker instead”, it's wrong. It's the retailer's job to sort it.

    It doesn't matter if it's an iPod from a high street shop or a designer frock from a department store. If something's broken, torn, ripped or faulty, the seller has a legal duty to put it right as your contract is with it.
    The manufacturer owes you nothing beyond the terms of the warranty/guarantee.

    SoGA allows you to seek a remedy from the seller for up to six years from the date of the sale.

    It's not complicated at all. After 6 months the onus is on the buyer to prove to item did not conform to contract (ie faulty) from purchase. I think you're confusing the period for the burden of proof and the period within which a buyer can reject an item for a full refund.

    Under the sales of goods act goods must last a reasonable amount of time and a washing machine should last longer than 2 years.

    Yes, but as mentioned in the post immediately above yours, it is for the buyer to prove that the fault is inherent.

    It has - it has lasted 26 months.
