  • @new666uk, I don’t recall if this pothole had already been logged to them. All I did was send the form from here to them with pictures of the damage, location map, times and a picture of the pothole with a ruler so they could see the state of the hole.

    Is a single alloy replacement safe if the others are different, I am not convinced.

    I am looking for advice on a claim which has been rejected. We have asked for freedom of information and the pothole was ‘repaired’ within the 5 day window, however, all they have done is filled the hole with sand which now means that it is just as it was before. They have said they have fixed this to tick a box but our argument is that it has not been adequately fixing. Do we have a claim to pursue this further?

    Need a bit more information.
    What date did you hit the pothole?
    When did you claim?
    Was the pothole reported to the council prior to your claim? If so, was it fixed before or after your incident?

    We hit the pothole hole on 28/04/19 and the pothole was reported by us on that date but had been logged as an issue by the council on the 26/04/19. The ‘repair’ was carried out on the 01/05/19.
    Our car was 2 days old and cause over £1000 worth of damage. The reason we ended up his this hole was because another car we travelling in the opposite direction and it is a country road with no markings so the car was slightly on our side of the road.

    You've no grounds for appeal then. They repaired it within a reasonable time of it being reported. You're just unfortunate to have hit it in the meantime.

    The quality of their repair is immaterial to your claim because you hit it before the repair. If you think their repair is inadequate, report that to them but it makes no difference to your claim.

    Same story - Hit pot hole damaged alloy wheel, tyre, front suspension and steering in April


    Had the front suspension repaired and the wheel tempoarily repaired with a old replament tyre to get car back on road. Have claimed to Aberdeenshire Council and they have JUST admited liability with a letter form there solicitors.


    Problems are
    1) Alloy Wheel is obsolete so couldn't be replaced ( would need to buy 4)
    2) I'm out of pocket for interium repaires
    3) I sold the car as the car pulled badly to one side after hitting pot hole and interim repair even though it had had the suspension redone and the tracking aligned.


    So today got told they are only liable for the Alloy that is damaged and the suspension. As there is no photo showing the tyre was damaged thats not covered. So I'm out of pocket

    Changing of a tyre which replaed the snow tyre that was on there with a part worn summer tyre
    Technically the'll only buy 1 alloy
    And the cost of changing my car (my choice). I probably won;t have sold it if I hadn't hit the pothole.


    My out of pocket expenses ..... about £2500


    Chance of recuping money maybe £350-400 ... (If I can provide receipts)


    But 1) I've sold the car so no point in buy an alloy
    2) I've only got the recipet for the suspension work as the rest was a tempoary repair (casher) at the local garage.

  • Could any of you help, please ?
    My local authority (RBWM) has refused my fast claim blaming Thames Water for the failure of one of their repairs.
    Has anybody claimed against Thames Water & how have they done it, please ?
    I have searched their website & cannot find a means of initiating a claim.
    Is it a coincidence that it is near impossible to even Contact the correct department ?

  • Can anyone please offer any advise/help.

    I am currently taking my local council to the small claims court and their solicitors, have picked up on a legal technicality and are trying to get it 'struck out' because the car is a leased vehicle, we are not the legal owners, we have very compelling evidence, witness statements ect for a very strong case, the council have also offered mediation, which is interesting.

    Any advice is much appreciated. In November 2018 I started a claim with the council in February 2019 they rejected my claim using section 58 defence. So since February 2019 I started my own investigation on how the council conduct these inspections. In March 2019 I identified a number of pot holes on the same road that was twice the councils intervention level of 80mm. So every month I took pictures due to this section of highway been inspected every 4 weeks. In July 2019 I reported it to the council and the solicitors, 2 days later the councils inspectors marked it for repair. Now January 2020 it’s still not been repaired. So I was going to use this against there section 58 defence due to them not showing a valid or reasonable inspection system. However the councils solicitors is trying to say I can’t use this due to it not been the pot holes in relation to my claim. Which is fine but it’s to be used against there defence. Can I do this and use it if I take them to court.

    Potholes are a pain in the !!!. I am always collecting and yes they will try to deny it but damn if I am not going to get my moneys worth because you didn't fix the road on time. We do pay taxes for them
