    the new agent has our details because he dropped a business card through the door, and my wife called him to see what he wanted!

    She's spoken to him again this morning - he has said they are a new agency with an office to open in a neighbouring town in Dec. In the meantime they are trying to drum up business, and selling some properties in another nearby town. They have a client who grew up in our town but lives 50 miles away now, and wants to move back. Apparently he is only interested in dealing with this new EA (they didn't elaborate as to why), but he's seen our propertly online and is interested as he likes it and it's the only suitable house in his price range....

    New EA have said that they will confirm all in writing, but the would like us to end our relationship with current EA and go with them for 12 weeks on a sole agency basis - he has said in return, as he is looking to drum up business/clients, that he will ask for NO agency fees on a sale for us within the 12 week period. He's said the usual stuff about our current EA having lots of "higher value" properties to sell so ours is probably lower priority for them, and he would do a lot more to proactively sell ours.

    A lot of what he said made sense, and we've agreed to meet him in person tomorrow. I guess if we do decide to proceed, then as many of you suggest we'll get everything in writing.

    You'll be very lucky to complete in 12 weeks even if he has a buyer ready to say yes. So you can probably rule out the 'no fee'.

    Plus he isn't actually promising 'no fee' just that he'll ask for it...

    And he still hasn't explained why the 'buyer' prefers to buy through someone who isn't actually your agent (and may never be).


    It all just sounds like spiel (i.e. horse shi*) to me.

    12 weeks is a long time if he's crap. Is he really offering to sell your house for free? Whatever you do read everything carefully and believe nothing he says that he won't put in writing.

    In my view a 'sale' in 12 weeks only means finding a buyer within that time, not completion. That will happen as I'm pretty sure the EA has a buyer.

    Maybe, but i'm pretty sure in the eyes of the law, a sale occurs at the point of completion when the funds are received. This is on of the things to negotiate and get in writing.

    How are you sure the EA has a buyer? The 'buyer' has never seen the interior of the house and may want to offer 20% less than asking price.

    Well, as I stated in a previous post, I was in a similar situation and sold immediately, so unless the property is poor, I'm pretty sure they will get this sale.

    Obviously the seller needs to confirm this particular with the EA.

    It is possible (heaven forbid) that the EA is exaggerating. I have heard of this method from several EAs (personally and on this website).

    Let's assume we cant be totally sure that the buyer exists or is that he is willing to buy the place at terms acceptable to the OP. Even if he is willing and able, 12 weeks is pushing it for many purchases.

    So if I was OP I would be looking to have the buyer introduced on a one-off basis (with or without a fee, as per negotiations).

    If the OP is of the frame of mind to move EA anyhow, 12 weeks is too long a contract, seeing as the EA is so confident he has/can get a buyer.
