Consumer Contract Regs vs T&Cs

Hi All,

I booked a 2-hour snooker session at Rileys on Sunday to play with my SO but she has since fallen ill so I would like to cancel. However, in their FAQs it states:

Q. I booked a table but now I can’t play on the requested date. Can I change the date and time of play?

A. Unfortunately once your online booking has been confirmed and payment received we are unable to cancel or amend the booking. Therefore please make sure that you and any guests you invite to play are available on the day and time you have chosen. Please refer to our terms and conditions (paragraphs 2 and 17) for further details.

and, rather unsurprisingly after reading the above, upon checking the terms it states that:

Online Purchase terms.
2. There are no rights of refund or exchange and you acknowledge that the cancellation rights contained in the DSR (as amended) do not apply to the services we offer.


Checking the (new) Consumer Contracts Regulations that have replaced the DSR (on which, as I find it much easier to read than the actual govt website), I can see that it states:

Exemptions There are some contracts where you won’t have a right to cancel a service. For example, hotel bookings, flights, car hire, concerts and other event tickets, or where the trader is carrying out urgent repairs or maintenance.


How do I find out whether this would apply to a snooker and pool club?

  • If you booked to play at a particular time then the contract is exempt from the cancellation rights provisions in the Consumer Contracts Regs.

    Regulations 28 - Circumstances excluding cancellation
    (h)the supply of accommodation, transport of goods, vehicle rental services, catering or services related to leisure activities, if the contract provides for a specific date or period of performance.
    Common sense?...There's nothing common about sense!
