Buying from small shop

Hi I recently bought a dress from a small local boutique for £120 via their online page. I paid through PayPal but when I received the dress it was of poor quality considering the price and also far too long for me. I returned it after 10days of receiving and she has since told me that I am only allowed a credit to use in store. Since investigating It does state on the website that they offer exchange or credit only but I believed that as it was bought online it was covered by the consumer contract regulation. But she has refused saying that as she is a small independent shop she doesn't need to comply together. Is this correct?

    No, she is not correct. The Consumer Contracts Regulations apply and you are entitled to cancel the contract. If she wishes to trade online she must abide by the law.

    If she complied with the regulations regarding the information that must be given to you then you need to send your cancellation to her within 14 after receiving the dress, and then return the dress within 14 days of sending the cancellation.

    I suspect she did not send you the required information though if she thinks the regulations don't apply to her. If so, then those timescales are much longer.
  • Frugal Mike is quite right - the Consumer Contracts Regulations do not include any exemption for small businesses and she is either ignorant or trying it on.

    I would also agree with this - she probably hasn't given you the information required under Schedule 2, paragraph 1 of the Consumer Contracts Regulations 2013, therefore, under Regulation 31(3), the time for cancellation extends to one year.
