Trust bank account

Hello experts :)

I've recently been helping a 16 yr old who has been going through some troubles and he's asked me about money that has been given to him from aunts and uncles at xmas and birthday with cheques made out to him. They were put into a bank account in his name (we believe) but his mother was the main trustee and there is several thousand in there. Communication with his mum has totally broken down and she's doing everything she can to make his life a misery. Is there anything we can do to freeze this account or get him access to it now he's a young adult? We have very little info, we just know what bank it is but he is worried if he mentions it at all to his mum she will just go close the account and keep the cash.

  • It depends.
    If it is a trust account then she has to act in the best interest of the benefactor - get legal advice about this.
    If it is an account in mum's name Re son then the money is hers until a court says otherwise - it will be difficult to get a bank to freeze the account on the say so of a third party - again legal advice should be sought.
    Lastly if the account is in the son's name with mum as controlling adult - at 16 a bank could change the signature on the account.


    Before commencing legal action get more information about the account - if mum has spent the money lets be honest nothing can be done.

    The Trustee must act in the best interests of the beneficiary in this case the son.
