Hi all

Im Ben im new

Im a self employed hgv driver and im looking for some basic terms and conditions to put on my invoice mainly about paying on time/how to pay.

I also do work for agencys and looking at putting somthing on there along the lines of " you agreed id have work on set date i turned down work at other places to work for you i got there and there was no work so you still have to pay me a set 8 hours pay at £* per hour"

can anyone of you smart people help a computer newbie out
idealy so i can just copy and paste onto the back of invoice

  • Do you not have contracts with these people, particularly the agencies? Do you invoice your clients prior to providing the service?

    Whilst you can reiterate payment terms etc on an invoice its potentially too late to start including additional clauses, especially the one you want re agencies. This is particularly if you invoice after service or failed job

    As above, you can't hope to unilaterally create additional terms and conditions once a contract has been established, you believe you have carried out your side of the bargain and are now invoicing for that.

    However, if you want terms for establishing new contracts, I suggest you seek independent legal advice as you may later need to rely on those terms to get paid.

    The internet, and especially internet forums where you do not know who is posting, is not the place to obtain such vital legal advice you are seeking, and which you may need to rely upon later.

    Perhaps you need to look at your pricing structure?
    e.g. £y per day (being the product of 8 hours x £x per hour) for the first initial 8 hours worked per 24 hour period plus £x per additional hour or part thereof worked in such 24 hour period?

    But that might put off a heck of a lot of potential clients, but that is what you are essentially asking.

    Costs/prices paid and related terms tend to fall to the biggest party (who can essentially pick & choose). This would also be the case with agencies who would expect you to agree to their charge rates & terms without any negotiation. There's a queue of lorry drivers behind you looking for work (and willing to accept them) if you don't want to accept ;)
    I would expect any half decent agency to specify in their own terms when & how they will pay you.

    I'd expect them to propose the initial terms but terms are always negotiable. The question of how negotiable depends how much they need you/ how easily replaced you are.

    In the last decade I am yet to sign an agency contract as first presented but I do a moderately specialist job and so have the luxury of being able to make certain reasonable demands as the end client wouldnt want the ball ache of interviewing more people for the sake of what I am asking the agency to do.

    Everything in business is negotiable.

    But as I said, and you appear to agree with me, when there is a queue of people behind you willing to snap someone's hand off, any possible negoiation is usually restricted along the lines of take it or leave it ;)

    Not only appear to agree with you but its exactly what I said

    I wont claim to have any knowledge of the HGV market to know if all HGV drivers are equal or if there are specialist skills that some have or even if its a buyers or sellers market. I dont think the one episode of Ice Road Truckers I inadvertently watched really counts
