Harveys - Faulty Sofa - Not happy with options

Hi,

I think I already know the answer to this but just wanted to check anyway.

Bought 2 matching sofas (one 3 seat, one 2) from Harveys (delivered May this year).

The 3 seater has developed a fault which has been confirmed as such by their engineer.

The sofas have now been discontinued

We have been offered: repair (with £100 compensation), refund for only the large sofa or reselection for the large sofa.

Repair doesn't fill me with confidence and they have advised we would be waiting 14 weeks anyway for the part before they could even do that.

If we get a refund/reselection, we would then be in the position of having a non matching suite.

Can we insist on refund/reselection for both considering they were bought together - I suspect the answer is no as they are actually separate items but one can hope!!

If we wait for the repair and it doesn't work, we would be looking at nearly 6 months since delivery which would mean if anything else happened we would be at their warranty's mercy. (And although they come with 10 yrs manufacturer's warranty), I am concerned that if we accept the repair option, it will be seen as a full and final type thing.

Can anyone offer any advice please.

  • Cut your losses with Harvey's.

    Get a refund while it's on the table if the other one develops the same fault you have evidence of an inherent fault.

    Get the refund, you wont get anything better than that.
    Settees don't have to be matching, buy a black or cream similar one or cover both with
    the same throws.


    That's about it really. They could actually insist you had a repair. That's the legal aspect of it.

    I appreciate this but we bought it as a matching suite and I don't want odd ones. My previous old sofa had throws on it and it looked tatty. And I didn't spend all that money just to cover my sofas with throws again.

    I am aware that a repair is all they have to offer, but I believe this has to be without too much inconvenience and I think one could argue that a 14 week wait on top of the nearly 4 weeks they've been 'looking into it' is quite inconvenient. I would be quite happy for a repair if they could guarantee it would work and we wouldn't end up in the same position again with nowhere to go. All I want is what I ordered and paid for to be in decent working order.

    I realise that now thanks and only realised that there were so many negatives after I had ordered and was too late to cancel. We went to Harveys because my sis in law and friends have both had suites from there that have lasted (well) for years. Regardless of their quality, they still should last longer than 4 months.

    Did you buy them as one set or as separate pieces of furniture?

    If as one set then you could possibly argue that you are entitled to a refund for both of them, because it was described as a set and without the second part then it is no longer as described

    If as two separate items then unfortunately no recourse whatsoever. Accept the repair or refund at your preference. By the way, the 100 pound compensation for a repair could be considered a more than reasonable payout for the inconvenience caused by the repair time frame

    Thanks. I thought I knew the answer and it seems I was right unfortunately. As I said, just wanted to check.

    I think I would be happy to accept the repair as I love the sofas but where would I stand if it became faulty again say after a short period of time (but after the initial six months since delivery). As they are guaranteed for 10 yrs, would they still have to do something?

    I know manufacturers warranty is different from sale of goods but. I worry that we would have to fight for a further remedy if needed. If the repair is successful, I would be happy but seeing that it has failed so soon, I am just not confident.
