Rental Deposit - Credit Card

Hi,
My landlords letting agent has done a bunk with my deposit but I just found out that I paid this with my credit card.
Q1. if I cant get it back from the letting agent, could I get it back from the credit card?
Its just over a year since I paid (1 day over).
Any idea how I can claim.

I don't think you can claim on your card.
Ultimately it's for your landlord to refund your deposit.0 -
Not likely, but I couldn't say for sure.
You should sue the landlord for the money, as their agent should have protected it in the relevant way.0 -
In general. if there has been a breach of contract, and you have suffered a loss as a result, the Credit Card company is jointly liable.
Has the contract (AST) been breached (yet)? i.e. Has you tenancy ended, and has your deposit not been returned?
Why are you thinking of pursuing the Credit Card company instead of the landlord?0 -
The landlord is an OAP, not rich just letting out his flat so he can rent another one elsewhere (somewhere nicer!). He's been let down by his agent too.

OAP or not, by letting out his property your LL is running a business and as such should have enough of a buffer to cover such eventualities. I hope he is registered with the local council as a landlord and is paying income tax on the rental income.
If you were the kind of person who likes to kick a man when he's down then you could sue for your deposit not being protected. I wouldn't and I doubt would either but the loss of the deposit is his hard cheese.0 -
It's your landlords problem not yours. It was his responsibility to protect the deposit and if the agent has done a bunk then it's up to him to chase the money.
Are you sure the deposit was never protected? If it wasn't, it was foolish for your landlord not to check that it was.
I can understand feeling sorry for him but you're paying him a large chunk of money every month and don't owe him any pity.0 -

He has been genuinely affected.
So what ?
He/she is running a business. If they are not aware of pitfalls of running a business, then they shouldn't do so.0
