NTK for parked on Double Yellows

I received a note to keeper for being 'observed parked outside of a marked bay', and IIRC I was parked adjacent to double yellows outside a restaurant to collect a takeaway at the local retail park. I was there for no more than 5 mins, between 8pm and 9pm.

Is this something I can appeal? Is this offence the same as being 'parked outside of a marked bay' as it doesn't specifically mention double yellows in the note to keeper? They want £100

    I guess this is a private parking charge rather than a council one?

    Which parking company please?

    Timeline of parking event and date of NtK?

    Do they mention Protection of Freedoms Act/Keeper Liability/POPLA in the NtK?

    Was a ticket attached to your windscreen or was it by ANPR operation?

    Someone calling themselves ukcps ltd
    Private land (cinema complex, bowling etc)
    Offence in September, NTK arrived in October, no ticket left on the windscreen
    Their letter mentions 'you may appeal to POPLA' if appeal is rejected, 'Protection of freedoms act' and nothing I can see about keeper liability. I have a photo of the letter, but cant attach it

    Use the appeal template in the NEWBIES FAQ sticky, in post #1. It's highly unlikely your appeal will be allowed, but you're really fishing for a POPLA code where you can kick this permanently into the long grass.

    After sending off the appeal (do it online if their website allows this) start reading up on POPLA appeals, again in the NEWBIES FAQ sticky, but this time post #3 and the blue link 'How to Win at POPLA'.

  • Why highly unlikely to win an appeal on private land? Just as unjustifiable as any other fine. I thought the ethos here was to fight.

    I think you misunderstand me.

    90%+ of initial appeals are rejected, but once the POPLA code is gained (via the initial rejection) you can draft your appeal to POPLA (with checking via us before despatch) where we've won hundreds and hundreds over the past 2 years - virtually (bar a couple) a 100% success record.

    There's no 'ethos' conflict here!

    UKCPS has been known to cancel on receipt of the first appeal. It's dawning on them that, when they see a forum appeal, the next stage (PoPLA) will cost them £27 and they will lose, so they might as well cancel now.

  • You have posted in Tazziegirl's thread that you are in Scotland. I think the advice is, therefore, different i.e. ignore?

    I know, without even reading the threads specifically written for them and coming on asking the exact same questions. I agree - ridiculous!
