Refunds only for some customers

Hi

Would be grateful for any advice, I own a child's car seat that WHICH have recently tested and they gave A 0% safety rating. Although the seat has apparently passed EU standards.

This seat was from Argos.

Although Argos, say their stance is they will not refund, they have apparently refunded some customers for this item. But now say they will not refund.

Can they legally be selective over who they refund? Do they not set a precedent once they have refunded person or persons.

Would appreciate any help give.

I have stopped using and will not use this chair again, regardless of refund. Child safety is of more importance.

    Yes they can make that choice.

    All you have to do is prove to them that your seat is inherently faulty. The fact that Which have said the model is not good is not proof that your particular seat has an inherent fault.

    You haven't said when you bought the thing, but if it was less than six months ago then you don't even need to prove that.
    Within six months from purchase it is for the seller to prove that the goods were not faulty at the time of sale.
    Maybe it is on that basis that they are refunding some and not others... but I don't know.

  • Do you have a link to the car seat or the Which? report about it?

    Which model is it? There are 2 with a score of zero and one of them has a recall from the manufacturer for certain batches.

    One is the Axkid Kidzofix, the other is ABC Design Risus 0+ Isofix base

    The first appears to have a problem with certain serial numbers

    The car seat is a baby start multi recline. I believe they are only sold by Argos.

    I'm sorry, but I'm not sure about doing links, but the original article is in the Daily Mail.

    It is a bit scary that it failed the WHICH testing so badly, but passed the EU standard safety tests.

    You still haven't told us when you bought it.

    Depending on that, it might be easy to get a refund.

    Thank you, but the Daily Mail report mentioned is dated 27 Oct 2014.
    Argos are quoted as still selling the few remaining in stock at that time.
    Apparently, it was removed from their catalogue in July this year.

    So it could easily been quite recent that the OP made his/her purchase.
