CCJ from Parking Eye - please help!

Hi,

I am new to these boards. I have received the following letter today, but it's dated 31st October, from Parking Eye:


Date of Event: 01 February 2014

Outstanding Parking Charge Amount Due: £175

Dear Sir / Madam,

ParkingEye has previously written to you at the address you had registered with the DVLA at the time of the Parking Event. However it has come to our attention that you no longer live at this address but reside at the above address. This new address has been supplied to ParkingEye by a Credit Reference Agency. For further details of this please see the reverse of this letter.

ParkingEye acquires its Registered Keeper details from the DVLA. It is the duty of the Registered Keeper to ensure that they update the DVLA with any new address. Because this had not been changed, ParkingEye has sent numerous pieces of correspondence to an incorrect address. This included a Notice to Keeper, two further notifications and a Letter Before County Court Claim.

ParkingEye could not have reasonably known you were at a different address and therefore having not received any response to the above correspondence ParkingEye issued a County Court Claim to the Registered Keeper's address. Subsequently we requested Judgement on this Claim.

We are therefore notifying you that there is currently a County court Judgement (CCJ) on your credit record. An outstanding CCJ can adversely affect your ability to gain credit and will damage your credit score/rating. We therefore require payment of £175. Once this payment has been received we will notify the County Court Business Centre as soon as possible to ensure that the CCJ is marked as "satisfied". This will improve your ability to gain credit.

They are claiming I over-stayed at a Morrisons branch that offers time-limited free parking. I had moved to my current address in May 2012. I am happy to defend myself in court. Please offer me clear advice on what I should now do.

I am guessing: apply to set aside the CCJ. Would this cost me £155? Will I be able to get that £155 back? I am very concerned about damage to my credit rating from the CCJ.

I did update my address with the DVLA after February 2014, but surely the court should accept that it's not fair for me to have a CCJ when I did not receive a single letter from either Parking Eye or the County Court?

I have proof that I moved house to my current address in 2012.

Extra info: I only realised the DVLA still had my old address when my car got clamped on the street in May 2014. It was a debt collection company who clamped me because I owed a Congestion Charge fine. They had of course written to my previous address. I paid over £500 to release my car, then filled in the necessary PE2 and PE3 forms and got every penny back. The reason was that I never received anything sent to my previous address.

    Yes, pay £155 to get it set aside as long as you are prepared to do the homework to defend it. Sounds like you are a good candidate to do this if you beat a £500 penalty by getting it refunded which is no mean feat!
