First timer - can I ask for help

Hi, I recently received an NTK for parking overnight in a 'free' car park the charge is £100.00. I'm going to appeal as I think its totally disproportionate however I'm a bit nervous about doing so.


I've read a lot of the excellent advice on this forum and have copied exactly the initial appeal letter in the newbies thread. Am I right not to add any additional info to that letter?


For example I wasn't given an initial PCN at all either stuck on the car or via the post - should I mention this at all? I have looked the photograph of my car on their website which was taken 2 min after the issued time of the PCN and there is no evidence of a ticket on the car.


Also at the time I got the notice (Sept) there was hardly any signage at all - presume it must have been somewhere but neither I or anyone else in car (who uses the car park regularly) saw it. They have recently added lots more signage presumably as they agree the original wasn't sufficient. Should I mention this or save this for the next step?


Would appreciate any advice before I send my first appeal off.

    This is exactly why I don't like template letters, people blindly copy them even when they don't apply to their particular circumstances.


    Use that letter, and make sure the main points are all in your letter, but rewrite it in your own words and include any other relevant info.

    I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.

    Not really - I hate templates as well but finally provided one for people who can't manage to write letters these days. Astonishing how many people still ask for a poxy template to write an email as well (in fact my own children had to be taught by me how to head up, set out, address and sign off a formal email, which shocked me). I do hope that most people 'could' write their own version taking tips from the example in the NEWBIES thread, making sure they don't say who was driving.

    And the most obvious thing is to add your name and of course, postal address...we've even seen people ask about that. 'It's a letter, so yes', is the answer we keep having to give! Even if they email an appeal if they just bother to read the 'ticket' they'd see it asks for the postal address in any email. Hmmm!

    Anyway it's good that you found the example and decided to use it - and lots of people use it verbatim. So let us know what happens!
