Expansys - Bunch of crooks?

A Pal of mine needed a new phone, budget of about £300. I still believe the best phone right now is the 32GB Nexus5 for that sort of money, and the only people that still have stock was Expansys.

He ordered, it arrived next day, and overjoyed with it. However after 2 days, the screen packed it, just pixel noise all over it.

He phoned Expansys, and they offered a repair, and it would take upto 30 days. Can they legally do this? Surely the product was not fit for purpose, and he is entitled to either a full refund or a replacement (if available). They are showing stock.

He isn't having much luck with their CS, and now i'm feeling bad for recommending them....

    I would say that 2 days is well within what be classed as a reasonable period to reject a faulty item for a full refund. Get your mate to look at the SOGA and quote the relevant parts to the company and if needs be be prepared to write an LBA (letter before action).

    A FULL REFUND
    You are legally entitled to a full refund if you have not yet 'accepted' the goods. Acceptance takes place when:

    you inform the trader that you have accepted the goods
    you use the goods in a way which is 'inconsistent with the trader's ownership'. For example, if you have altered the goods in any way or customised them then you may have accepted them. For example taking up the hem on a pair of trousers
    You keep the goods for longer than a reasonable time without telling the trader that you have rejected them. You are entitled to a reasonable opportunity to examine the goods and this should take place within a reasonable time. The law does not give an explanation of what is 'reasonable time' and ultimately a court would make a decision based on the facts of each case. You should, therefore, contact the trader as soon as you find the fault as a delay may mean you lose your right to a refund.

    Thats because whats reasonable for a ruler wont be reasonable for a tv. And also because what is a reasonable time is a question of fact - meaning it can only be decided by a judge.

    For example buying skiing equipment in summer - a reasonable time may be extended until winter.
