employer will not send P45

I have a full time job but until recently I worked in the evenings as well cleaning. I left on the 15th October and got my pay and payslip on the 28th October as normal, but no P45. I spoke to my accounts team at my main job who advised me that I have been on the wrong tax code for a while and I should call HM revenue to get it changed. When I called HM revenue they knew nothing about me leaving my cleaning job. They have changed my tax code for now but said I need to get the P45 off my part time cleaning job to confirm I have left and so I can proceed with claiming back tax I am owed. I have been on the phone to the cleaning company everyday chasing but they refuse to get back to me, I then started emailing the head of the company who is also ignoring me. I don't know what further action to take in order to get this sorted, has anyone got any advise whether I should proceed legally about it or who I need to inform please?

Can you not just fill a P46 in?Don't trust a forum for advice. Get proper paid advice. Any advice given should always be checked0

I was under the impression a P46 was if I was to start another job, but I have just simply left and now sticking to my one main job ?0

They should have sent 1 copy of the P45 off to the Inland Revenue. sent one to you and kept one for themselves.
Can you not go to the company physically and demand it.
What tax code were you on at both jobs and what tax code are you on for your single job now.make the most of it, we are only here for the weekend.

Thanks for the website I will look into it. I can't go to the office as it is far from me and not open on weekends so I wouldn't have the time to go over there to see them. Also I was on BR tax code on both jobs.0

How much will you earn in the current tax year (pay days in the period from 6 April 2014 to 5 April 2015) in your remaining job? If both employers were using BR, then you would get all overpaid tax back in your remaining job as long as the earnings there are above the personal tax-free allowance. From that point of view you don't need a P45 from the other employer. So write a letter (rather than an email) to the payroll department with a copy to the "head". I don't know what further action to take in order to get this sorted, has anyone got any advise whether I should proceed legally about it or who I need to inform please?

Were you working for either of these companies on 5 April this year? If so, did you get a P60 from either or both?0 -
yes I have received a P60 I believe from my main job but I will have to check the part time job but I was working for them for 3 years so I should have one.0

some companys take quite some time to 'process' the P45 and send it out to you - the longest I had to wait was 3 months.
In the meantime, you CAN use your last payslip as a sort of interim P45 (I have doen this) as it will have all the info the HMRC need to process your claim.just in case you need to know:

The part-time job employer (like all employers) should have provided a P60 by the end of May. If they have not done this, it is not a good sign regarding the conduct of their affairs with HMRC. Did HMRC have any record of your working for them?0
