Hello all.
Back in November 2013 I bought a white gold diamond ring for my wife costing £200. Less than 11 months down the line the ring has a split in it. After talking to the company, they told me as 6 months has passed they will not refund or replace the item and there is nothing they will do about it. I told them the ring is of inferior quality, not fit for purpose, and has not lasted a reasonable amount of time. Any advice on what to do next?

    The company are acting within the law.

    Have you read MSE's Consumer Rights guide?

    In there you will find:
    When goods are faulty, if you return them within six months, then it's up to the shop to prove they weren't faulty when you bought them. After this, the burden of proof shifts and it's up to you to prove they were faulty when you bought them.
    This means that they do not have to do anything until you prove to them that the problem is due to a fault that was present at the time of sale but not necessarily apparent at that time.

    You will need to get an independent report that states the fault is inherent, i.e. not caused by misuse or fair wear and tear, before the seller needs to do anything more.

    Ok thanks for that. As I said to the person on the phone, I am sure 11 months is not a reasonable amount of time for an item to last. Think i'll take a trip to a jewellers to get it examined.
  • Looking at the pictures that looks like it may have got trapped in something - thats personal opinion though.
