Hi
Looking for some help deciding how to appeal this ticket received when attending an urgent dr appointment.
I brought a ticket and displayed it and was shocked to find I had parked in a staff bay denoted by a separate sign for the particular clump of bays.
Is a very small carpark full of hedges and only actually a dozen patients spaces on reflection. I had to attend in my van which ruled out one side of those bays all together !!
I acknowledge all your detail post on legal grounds but have not found any story's of appeals against this company on those.

Have you read the Sticky thread for NEWBIES yet? It gives all the info you need on how to beat this scam.
Was this a windscreen ticket or NTK? Was this in England/Wales or Scotland/NI as the advice is different?
Don't appeal yet until you have read up on the next stage, but be aware of time limits imposed on you so you don't miss any appeal deadlines.
Not so Smart Parking are members of the BPA so make your first appeal by copying the Template in the aforementioned NEWBIES thread.I married my cousin. I had to...I don't have a sister.

I have read the thread but was just looking for reassurances on his will this appeal process has gone against Smart.
It was a windscreen ticket so far....

So I guess I'm waiting for the NTK which I guess will arrive after 14day initial discounted rate goes un accepted !!!:money:
Do smart usually send ntk's?

Yes, you wait for the NTK as this gives not so smart the chance to c0ck up and send something non-compliant. This won't be a winning item but it is always worth adding in as an extra appeal point. Use the Template appeal letter in the NEWBIES thread for your first appeal when you get the NTK.
Forget the charge and the discounted rate, they aren't worth the bog paper they are printed on since you are going to beat these scammers at PoPLA.
Since not so smart are members of the BPA according to the BPA website, they must send a compliant NTK within the timescales in accordance with the BPA code of practice. Complaints to the DVLA, and BPA if you don't get one or it's non compliant/out of time. Never miss out on the chance to stick it to a PPC.
Just be aware that your initial appeal WILL be rejected but the PPC MUST provide you with a serviceable PoPLA which you then use in conjunction with the How to Win at PoPLA part of the NEWBIES thread.I married my cousin. I had to...I don't have a sister.

Yes and no! They send a non-compliant Notice to Owner which does NOT include any wording at all from paragraph 8 of the POFA 2012 Schedule 4 (take a look, the schedule is easy to read and linked in the Newbies thread fist post for those who want to 'dig a bit deeper'.Do smart usually send ntk's?
So guess what the outcome at POPLA HAS to be, if the driver has never been identified at all in the first appeal and then the keeper appeals to POPLA in the end and just says 'there is no keeper liability because Smart Parking have issued a non-POFA 'NTO' and not a POFA compliant NTK'?
Are you up for just sending those words alone at POPLA time? You'd win!PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
