please hold my hand ...

first time i've followed this.
so I received a windscreen ticket from UKPC. Not showing a disabled badge when in a disabled space. (we are legitimate my mother in law and I forgot to put the badge on show.)
So I've read and read.

Is my first step correct?
I have submitted online through the appeals on UKPC website and exact copy of your template for the first appeal. btw - the online appeal submissions only allow for max. 2000 characters so I have written in the appeal text box "please see supporting document letter. Is that OK?

So then it will probably get rejected and will they then give to me the popla number or do I have to request it? This has confused me a bit.

So sorry to take up your valuable time (I bow to you all you great people who help people).

    You should have waited for the postal notice, but no matter really.

    If their rejection does not include a POPLA code then they have breached the BPA code of practice ... motorists should NOT have to request one. (Although if you've used the template appeal then you have already made the request anyway, so UKPC would have no excuse whatsoever).

    The postal notice is the NTK, so you have done the right thing as long as you didn't say who was driving.

    See supporting document letter was also correct.

    You are doing OK so far so don't panic.

    When you do your PoPLA appeal, add in a section that this is a breach of the EA 2010 since the Blue Badge scheme does not apply to private land. Forcing a disabled person to display a BB on private land is a breach of the equality act since not everyone who is disabled has one. A BB is not the only indicator of a disability.

    Where were you parked? You should complain long and loud to the landowner or shop manager that a disabled person is being victimised and harrassed in breach of the LAW which trumps any made up rules from PPC.

    We were parked outside and went in and had a coffee and a peruse inside M&S. I will certainly write to them. Is there any risk of me giving them information which they could pass on to ukpc without realising they will be jeopardising my appeal? I.e. If I write the situation as it was to M&S, quoting the BB number and including the receipt fro the cafe as well as the member of staffs note to say they corroborate the evidence, if ukpc see that will it mess up the appeal process?

    Visit in store if you can but otherwise write to the CEO and the store manager. Contact details should be fairly easy to find on the internet.
    Assuming you have told the PPC you had your disabled MiL with you the BPA CoP says they should stop at that point. Complain long and loud to M&S about harassment, quote the Equality Act 2010 which is a criminal offence and both M&S and the PPC as their agents are liable. Don't mention who was driving, just say you are the keeper of the vehicle and your disabled MiL was a passenger in the car when she and the driver visited the store. Show a receipt if you have one but it doesn't matter if you can't. Show the BB or send a copy if you write. Demand that M&S cancel this fake unenforceable charge, and if they agree, make sure you get it in writing.


    Just be very careful how you word things and only use expressions like, the driver parked, not I parked, or my partner parked.


    Meanwhile, don't let up on the appeal process. Have a look at the How to Win at PoPLA section of the NEWBIES thread so you will be ready when the time comes. Post up your appeal on this thread before posting it, or let us know if the ticket gets cancelled.
