POPLA Rejections

As we are seeing more and more appeals rejected at POPLA, what are peoples thoughts on the reasons for this?

In what you used to be a guaranteed success in GPEOL, when you didn't even have to mention it, but only imply, these are now being rejected out of hand.

Is this down to "newbie" or rogue assessors?

I'm sure I have seen on here that the POPLA contract it is up soon, so could it be that they are trying to get back in favour with the BPA, so they can get the renewal?

Or could the PPC's be putting pressure on the BPA and threatening to jump ship to the IPC, as they see most appeals are rejected there and the appellant has to jump through many more hoops to win and therefore the BPA are putting more pressure on POPLA to reject more appeals in order to keep their members happy?

All of the above? :rotfl:

I think I've seen 3 - and for one of those I haven't seen the precise content of the appeal.

    Hardly 'more and more'.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

    Ok, fair enough.
  • I think its more a case of GPEOL statements are becoming more clever and this is really in relation to where the is an initial loss

This is where the different tact is needed
  • I think it is a 100% certainty there is a lot of politics going on in POPLA and increased pressure from PPC's through BPA. If the biggest BPA member PE can't gather enough effort to defend POPLA appeals (as we have seen recently) is it any wonder that there must be tremendous pressure in the background on individual assessors to change their ways.

PPC's are only interested in the financial yield they get from PCN's and see the £27 fee and the associated work as a real drag on profitability even though I understand only 2% of PCN's are appealed to POPLA.

Although situations do vary, most opinions on the real GPEOL are around the £15 to £20 mark and I do think a statement to that effect could be included in any POPLA appeal as a marker to assessors that what industry 'experts' have concluded. PPC's go into realms of fantasy in their estimates, as one would expect, so I think putting a marker down will be useful strategy.

    ^^^^^^^^^^ This ^^^^^^^^^^

BPA Ltd. has hit on a way of pressurising PoPLA without being seen to do so.
