3 mobile missold sim

I was mis sold a sim stating it to be a pay as you go,when it was a contract sim.The girl asked how much I was looking to top up each month and I said £15 ,she said to set up a dd so I did not have to worry about topping up... So I set it up.
As I did not use the phone very much after 9 months I cancelled my dad as I didnotuse the 3 sim.I got a bill stating I owed 2 months payments.I rang 3 straightaway asking why did I have to pay as I did not have a contract,it was a pay as you go,they then informed me it was a sim only contract! I was very angry and told them that it was mis sold .I paid the outstanding and also asked them to cancel the sim .They put n my credit file 3 missed payments which now effects my credit .I have rung and spoken to 11 different people and all of them keep telling me different things and saying they will get back to me,but they don't ...what should I do as this thing on my credit file is going to effect my mortgage application...

How will you prove that it was sold as a Pay As You Go SIM?

It's been a while since I've used a PAY SIM, do providers now offer DD as method of payment for PAYG - if not then that should have raised alarm bells as to what you were being signed up for?

I don't understand what missed payments you mean. You say you cancelled the sim and paid off the outstanding balance (which presumably includes the remaining months, or the early cancellation fee).
Do you mean you simply stopped paying?0 -

They cancelled the DD not the SIM0 -

It's been a while since I've used a PAY SIM, do providers now offer DD as method of payment for PAYG.
O2 have the facility for PAYG customers to have an auto top up (this can be done weekly or monthly) and can be paid for by credit/debit cards so it might be the case that some providers do a similar scheme and will allow a DD for this.0 -
I'm with giffgaff and am on a rolling monthly contract ... essentially PAYG, since the minimum term was one month. (I pay for the recurring "goodybag" via CC).0

Interestingly, three also do a month by month sim only deal with no minimum contract length (well, 1 month, but you get the idea). You do, however, pay a small premium over signing up for 12 months, but it's still cheaper than PAYG, especially for data.0
