No it's because they consider it pre-existing.
It's a long and complicated episode but I doubt I have much grounds for arguing it with them

Unfortunately insurance will only cover what is included in the small print. If you don't declare pre-existing conditions and specifically get them covered this is likely to invalidate claims.

It does seem that fees can be negotiated down. Maybe someone who has done this is Canada can advise on what the starting point should be.
