Student Council Tax Court Summon

I am a full time UK student and have just received a council tax court summon in the post.
It is asking me to pay the tax plus £82 in court summons. I am however no eligible to pay council tax as I am in full time education.
This means that I will be wrongly taken to court. If I call the council tomorrow to explain, will I still need to pay the court summon even if I no longer owe anyone money? PLEASE HELP

Have you previously told the council that you are a full time student, if not how do you think they would they know? What are your housing arrangements, do you live alone or with others, and if they latter, are they all students or are some of them non-students? Are you in a HMO?0

You are being taken to court correctly - until such time as the council are given the information and an exemption is awarded the charge remains due. They can continue to pursue you even if it's only the summons costs remaining (each council will have their own policy on whether they pursue or not).I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
